CONDITIONS OF HIRE
Definitions:
"Equipment" means the items hired out by the Owner to the Hirer.
"Hirer" means any person or entity that requests the Owner to hire Equipment to them.
"Owner" means Island Marquees Pty Ltd ABN 92 094 690 810
THE HIRER AGREES:
To pay all hire charges as invoiced by the Owner including charges for loss, damage and repairs, late returns, cleaning charges additional cost involved in moving
equipment, GST, or other expenses paid or payable by the Owner.
To pay a damage waiver of 7.5% of invoice total to cover breakages and minor damage. Any damage other than normal "wear and tear" will be invoiced separately
That deposits paid are partially returnable depending upon the time of cancellation and the loss of income incurred by the Owner as a result of cancellation.
Unless otherwise agreed final payment shall be made on or before delivery of the Equipment.
To bear responsibility for the Equipment hired from the time of its delivery until the time of its collection or return to the Owner. (This includes Theft and Vandalism).
That the Equipment delivered to a site shall not be transported for any reason to any other site without the direct approval of the Owner. Equipment moved shall be
considered to have been hired twice and therefore incur two hire charges.
To immediately check Equipment as to its number and condition and report any dissatisfaction back to the Owner immediately.
To bear liability without limitation for any costs incurred by the Owner in repairing or replacing the Equipment.
That the Owner has the right to terminate the hire and recover the Equipment at any time.
The Hirer shall have no claims for such termination.
The Owner does not accept any responsibility for any injuries to persons or damage to property belonging to the Hirer or anyone else, arising out of the hire of the
Equipment, however such injury or damage may arise or be caused.
That no warranty or condition express or implied is given by the Owner as to the condition of the Equipment or the suitability or fitness of the Equipment for any
purpose.
Where the Owner provides operators / Erectors as well as equipment such operators shall only be required to work in accordance with the direction of the hirer and
that the Owner will not be responsible for any error, defect or inadequacy in their work.
